The TM-A application is filed online on the IP India portal. You receive a unique trademark application number and can begin using the ™ symbol within 2–3 working days.

Examination and objection

The Registry examines the mark within 12–18 months. If objections are raised, our trademark attorneys draft a detailed response — included in the service fee.

Publication and registration

If accepted, the mark is published in the Trademark Journal for 4 months. If no opposition is filed, the trademark is registered and the certificate is issued.

Goods and services are classified into 45 classes under the Nice Classification system. You must apply in the class(es) relevant to your business (e.g., Class 35 for retail services, Class 41 for education). We advise on the right classes to maximise protection.

How long does trademark registration take?

The complete process from filing to receiving the registration certificate typically takes 18–24 months. However, you can use the ™ symbol immediately after filing and have priority rights from the filing date.

Can I file in multiple classes?

Yes. Each class is a separate application with a separate government fee. We recommend filing in all classes relevant to your current and planned business activities to build comprehensive protection.

What if someone opposes my trademark?

Any party can file an opposition within 4 months of Journal publication. Both parties exchange evidence and written submissions. Our trademark attorneys handle the entire opposition proceeding on your behalf — success rates are high with a well-drafted response.
