These terms govern your use of the FilingSetu platform and services. By engaging us for any filing, registration or compliance work, you agree to the terms set out below.
1. Who we are
FilingSetu is a technology-enabled compliance platform that connects Indian businesses and individuals with practising chartered accountants for tax filing, GST compliance, company registration, bookkeeping and related services. All professional work is performed by ICAI-registered chartered accountants.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement under Indian law to use our services. By placing an order, you confirm that the information you provide is accurate and complete.
3. Services and scope
Each service listed on our website has a defined scope, turnaround time and fixed fee. Before work begins, we confirm the exact scope in writing. Work outside the confirmed scope may require an additional engagement at a separately quoted fee.
- Fixed pricing — the fee shown on our website or confirmed in your order is the fee you pay. No hidden charges or surprise add-ons.
- Government fees — statutory fees payable to government bodies (e.g. MCA registration fees, trademark filing fees) are charged at actuals with no markup and are listed separately.
- Turnaround — estimated timelines are listed on each service page. Actual turnaround depends on document readiness, government portal availability and response times from statutory authorities.
4. Your responsibilities
To enable us to deliver your filing accurately and on time, you agree to:
- Provide complete, accurate and up-to-date documents and information as requested by your assigned CA.
- Respond to queries and approval requests within a reasonable timeframe.
- Ensure that all information shared with us is lawful, truthful and not misleading.
- Not use our services for any fraudulent, illegal or unauthorised purpose.
Delays or errors caused by incomplete or inaccurate information provided by you are not the responsibility of FilingSetu or the assigned chartered accountant.
5. Payments
- Payment terms — full payment is due at the time of placing your order unless a specific instalment arrangement has been agreed in writing.
- Accepted methods — UPI, debit card, credit card, net banking and bank transfer via our PCI-DSS-compliant payment gateway.
- GST on services — our professional fees are subject to GST at the applicable rate. The amount shown on your invoice includes GST unless stated otherwise.
- Failed payments — if a payment fails or is reversed, we reserve the right to pause work until the outstanding amount is settled.
6. Intellectual property
All content on the FilingSetu website — including text, graphics, logos, icons, images and software — is our property or licensed to us and is protected under Indian copyright and trademark law. You may not reproduce, distribute or create derivative works from our content without prior written permission.
7. Confidentiality
We treat all client information as strictly confidential. Your documents, financial records and personal data are shared only with the chartered accountant assigned to your engagement and with statutory authorities as required for filing. 8. Limitation of liability
FilingSetu and its chartered accountants exercise professional care in every engagement. However, our liability for any claim arising from our services is limited to the fee you paid for the specific service in question. We are not liable for:
- Penalties or interest arising from information you provided that was inaccurate, incomplete or delayed.
- Downtime or delays caused by government portal outages or changes in statutory requirements.
- Indirect, incidental or consequential losses, including loss of business or profits.
9. Cancellation and refunds
Our cancellation and refund policy is detailed on our Refunds & Cancellation page. In summary: if work has not yet begun, you are entitled to a full refund. Once a CA has started work, refunds are calculated on a pro-rata basis for the unused portion of the service.
10. Dispute resolution
Any dispute arising from these terms or our services shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, and proceedings shall be conducted in English.
11. Governing law
These terms are governed by and construed in accordance with the laws of India. The courts of Bengaluru shall have exclusive jurisdiction over any proceedings arising from these terms.
12. Modifications
We may update these terms from time to time. Material changes will be notified via email or a prominent notice on our website at least 15 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised terms.
13. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
